1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and neuera.care ("we," "us," or "our") governing your access to and use of our digital health platform, telemedicine services, and related offerings.
By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
These Terms comply with applicable Indian laws including the Information Technology Act, 2000, Consumer Protection Act, 2019, and Telemedicine Practice Guidelines issued by the National Medical Commission, 2020.
2. Services Overview
neuera.care provides:
- Telemedicine Consultations: Remote consultations with registered OBGYN specialists and healthcare professionals
- Personalized Care Programs: Evidence-based programs for PCOS, fertility, perimenopause, menopause, and women's health concerns
- Health Monitoring: Tracking and guidance through WhatsApp, email, and our digital platform
- Diagnostic Coordination: Facilitation of home-based and laboratory diagnostic services
- Nutrition and Lifestyle Guidance: Personalized plans from qualified nutritionists and wellness experts
3. Eligibility and Account Registration
3.1 Eligibility
To use our services, you must:
- Be at least 18 years of age
- Be a resident of India (services currently available in Delhi-NCR and Mumbai)
- Have the legal capacity to enter into binding contracts
- Provide accurate, complete, and current information during registration
3.2 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring your contact information (email, mobile number) is current
4. Telemedicine Consultations
4.1 Nature of Service
Our telemedicine consultations are conducted in accordance with the Telemedicine Practice Guidelines issued by the National Medical Commission, 2020. All consultations are provided by registered medical practitioners holding valid licenses to practice in India.
4.2 Limitations of Telemedicine
You acknowledge and agree that:
- Telemedicine has inherent limitations compared to in-person consultations
- Physical examination is not possible through telemedicine
- Certain conditions may require in-person clinical assessment
- Our practitioners may advise you to seek in-person care when necessary
4.3 Medical Information Accuracy
You agree to:
- Provide complete, accurate, and truthful medical history
- Update your health information regularly
- Disclose all current medications, supplements, and treatments
- Report any adverse reactions or new symptoms promptly
4.4 Prescriptions and Medications
Prescriptions issued through our platform:
- Are valid as per the registered medical practitioner's clinical judgment
- Must be obtained from licensed pharmacies
- Should be taken strictly as per dosage and duration instructions
- Cannot be shared with others
5. User Obligations and Prohibited Conduct
5.1 Acceptable Use
You agree NOT to:
- Misrepresent your identity or provide false information
- Use the platform for any illegal or unauthorized purpose
- Harass, abuse, or harm healthcare providers or staff
- Share your account credentials with others
- Attempt to gain unauthorized access to our systems
- Use the platform to obtain controlled substances unlawfully
- Copy, reproduce, or redistribute our content without permission
- Interfere with or disrupt the platform's functionality
5.2 Consequences of Violation
Violation of these Terms may result in immediate suspension or termination of your account, refusal of service, and legal action where applicable.
6. Payment Terms
6.1 Fees and Charges
You agree to pay all applicable fees for services as displayed on our platform. Fees are subject to change with prior notice.
6.2 Payment Methods
We accept payments through secure third-party payment gateways. You are responsible for ensuring your payment information is accurate and current.
6.3 Refund Policy
Refunds are provided as per our Refund Policy:
- Consultation Fees: Refundable if cancelled 24 hours before scheduled appointment
- Program Fees: Partial refunds within 7 days of enrollment if no consultation has occurred
- Diagnostic Tests: Non-refundable once sample collection is scheduled
- Technical Issues: Full refund if service cannot be delivered due to platform issues
Refund requests must be submitted to care@neuera.care. Processing time: 7-10 business days.
6.4 Taxes
All fees are inclusive of applicable Goods and Services Tax (GST) as per Indian tax laws. Tax invoices will be provided for all transactions.
7. Cancellation and Rescheduling
By You: You may cancel or reschedule appointments up to 24 hours before the scheduled time without penalty. Cancellations within 24 hours may result in forfeiture of consultation fees.
By Us: We reserve the right to cancel or reschedule appointments due to healthcare provider unavailability, technical issues, or emergencies. Full refunds will be provided in such cases.
8. Intellectual Property Rights
8.1 Our Content
All content on our platform, including text, graphics, logos, images, videos, software, and educational materials, is the property of neuera.care and protected by Indian and international intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our platform for personal, non-commercial purposes. You may not:
- Reproduce, distribute, or publicly display our content
- Create derivative works from our content
- Use our trademarks or branding without written permission
8.3 User Content
You retain ownership of health information and content you provide. By using our services, you grant us a license to use, store, and process your data as described in our Privacy Policy.
9. Disclaimers and Limitations
⚠️ Important Medical Disclaimer
neuera.care is NOT an emergency service. For medical emergencies, call local emergency numbers (108/102) or visit the nearest hospital immediately.
Our platform is designed for non-emergency healthcare consultations and chronic condition management. Do not delay seeking emergency care due to reliance on telemedicine services.
9.1 Service Availability
We strive to provide uninterrupted service but do not guarantee:
- Continuous, error-free, or secure access to the platform
- Accuracy, reliability, or completeness of platform content
- That the platform will meet all your requirements
9.2 Third-Party Services
We partner with diagnostic laboratories, pharmacies, and other healthcare providers. We are not responsible for the quality, accuracy, or delivery of third-party services, though we make reasonable efforts to work with reputable partners.
9.3 No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claim arising from your use of services shall not exceed the amount paid by you in the 12 months preceding the claim
- We are not liable for loss of data, service interruptions, or unauthorized access caused by factors beyond our reasonable control
These limitations do not apply to liability that cannot be excluded or limited under Indian law, including liability for death or personal injury caused by gross negligence.
11. Indemnification
You agree to indemnify, defend, and hold harmless neuera.care, its healthcare providers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use or misuse of our services
- Your provision of false or misleading information
- Your violation of any third-party rights
12. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.
13. Medical Confidentiality
All consultations and medical information are confidential and protected under the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002.
Exceptions to confidentiality include:
- When required by law or court order
- To prevent serious harm to you or others
- Public health reporting requirements
- With your explicit written consent
14. Termination
14.1 By You
You may terminate your account at any time by contacting us at care@neuera.care. Upon termination, you will lose access to active programs and services (refunds subject to our Refund Policy).
14.2 By Us
We may suspend or terminate your account immediately without notice if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- Your actions pose a risk to other users or our staff
- We are required to do so by law
14.3 Effect of Termination
Upon termination, your right to use the platform ceases immediately. We will retain your medical records as required by law. Provisions regarding intellectual property, disclaimers, indemnification, and dispute resolution survive termination.
15. Dispute Resolution
15.1 Informal Resolution
Before initiating formal proceedings, please contact us at care@neuera.care to resolve the dispute informally. We will make good-faith efforts to resolve complaints within 30 days.
15.2 Consumer Grievance Redressal
If you are dissatisfied with our services, you may file a complaint with:
- National Consumer Helpline: 1800-11-4000 or consumerhelpline.gov.in
- Consumer Forums under the Consumer Protection Act, 2019
15.3 Arbitration
Any dispute not resolved informally shall be referred to arbitration under the Arbitration and Conciliation Act, 1996:
- Arbitration shall be conducted by a sole arbitrator mutually agreed upon
- Seat of arbitration: Delhi, India
- Language: English
- Arbitrator's decision shall be final and binding
15.4 Jurisdiction
These Terms are governed by the laws of India. Subject to arbitration, courts in Delhi, India shall have exclusive jurisdiction over any disputes.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and NuEra Life.
16.2 Amendments
We may update these Terms periodically. Material changes will be notified via email or platform notice. Your continued use of such changes constitutes acceptance of the updated Terms.
16.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16.4 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
16.5 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
16.6 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, acts of government, wars, or technical failures.
